Hello,
I need your advice / opinion on the below scenario...
I and my wife are both employed at the same company, currently on H1.
I am the primary for our GC processing; my wife is dependent on me with regards to GC.
We both got our EAD and AP. 140 approved in May 2007, 485 Filed in Aug 2007.
I have submitted I-9 to the company in order to be on EAD status.
I am planning to have my Wife resign from the current employer and work for a diff company/vendor by using EAD.
Questions: 1.Does the above scenario bring up any issues with regards to our work status or any other issues with the current employer or to the GC process?
2. Can I work on a part time project?

Can I submit a new application for EAD renewal online when my paper based application is pending. Its been over 4 weeks and my check is not cashed and current EAD expires in 7 weeks.
Would it invalidate the first application ? The first application had a missing question that was rejected and I submitted it back about 4 weeks back, and no check encashed or response till now, so I was thinking if submitting an online application would help.

yes, you can. also, you could go to stamping even with expired visa. eitherway it doesn't matter. because at the start of your H1B interview they cancel your old H1B stamp.

Hi,
I got a contract offer at company A (Industry: Health) at a big city. Currently I am working for a State Government as a contractor. As per salary is concerned not much of a difference between the two contract positions. Me and and my wife are currently working but at different places. 2-3 months back we thought of moving to a big place so that the probability of the other person getting job would be more and we can stay together at the same place so I applied for Company A. They accepted my resume but because of the economy and budget constraints they hold the position and after sometime I forgot about it. I dropped the idea of moving and didn't apply for any jobs because of the current economy situations. Now last week after more than 2 months they reopened that position and interviewed me and I got the offer yesterday. Now I am in a dilemma whether to take this offer at Company A or stay where I am until the economy goes little better. My current job is stable. Added to that my wife's contract getting over in Jan 2009. I am cracking my head here thinking what's right thing to do.
Scenarios:
1. If I moved to Company A and my job is good and then after Jan my wife can look for a job at that place. (chances are more because of Big City). Everything is good.
2. If I moved to Company A and crisis is soo bad and I lost my job and from jan my wife contract is ending. After that it's just nightmare.
3. If I stay where I am and once the economy stabilizes atleast a bit and look for a job.
I really appreciate your suggestions. I know they are people in our forum who studied current economy so good and can give me a valuable advice. Thanks.

now come july 2007 , i file my wife's 485 that is filed by attorney B , now the situation is such i dont know who has my papers . I do have copies of filed 485 and approved I140 . I want to inform USCIS that all the correspondence not to be sent to Either A or B but to be sent directly to me , so How do i go about doing that , the only reason I ask this is so that i have more control over my case cause the above attorneys were picked by my company and not very forthcoming when talking to me , even though I am the one who paid for all the services

I don't think it is necessary to renew his passport in India. I heard though they suggest having 6 month of passport validity, POE will let you in even if the passport is going to expire the next day. At the time of entry the passport they are carrying should be valid.
I read this in a blog but use it at your own discretion.
BTW is your son is on H4? How could he be able to come to US on 1st Sep 2009 when the H1B expired on 14th Jan 2009? (or is it a typo and should be read as 14th Jan 2010)

Hi! I'm H1B holder and my company is willing to sponsor the green card. I'm coming from Eastern Europe (Moldova) and in US am working as software developer, I guess it's EB-3, right? I graduated in Romania Bachelor Degree in Mathematics & Computer Science (4 years) and Master Degree in Computer Science & Engineering (2 years). My work experience is more than 7 years. Now that 485 is allowed till 17th what should be a strategy for H4 visa. I am sure many of us must be planning to get married earlier and get our spouse here. If she is asked during visa interview about why sudden rush to get H4 should she just say family reasons or mention the intent to file 485. H1/H4 is a dual intent visa and thus as far as I know telling visa officer the reason for sudden rush is to file 485 should not be a problem.
But I want other peoples opinion on this. Any suggestions or does anyone see any potential problem with this scenario.

As long as you were in valid h-1b status at the time you applied for transfer, you can begin working as soon as you receive a receipt notice. Your attorney plays safe and is correct.
