Hi
Since I got electronic refund to my tax rebate and have SSN for all family members, I was expecting Tax refund (stimulus) to be deposited in my bank accoung this week. This was big announcement in the last week.
But I dont see any rebate deposited in my account?
Does any of you have received such rebates?
Is there any contacts numbers where we can approach if we did not received Stimulus rebate al though we filed electronically?

It is now on a list that sets it up for a voice vote in the house and will certainly pass. Unfortunately though it has only two provisions- extenson of the conrad program by 5 years and an increase in the number of flex spots.
We are hopeful that once the bill reaches the senate, provsions for GC exemption and H1 eligibility will be added on.

Last week I received a copy of �Approved I-140� using Freedom of Information Act. I took almost 7 months to get requested information. Following are the steps to use FOIA:
1. Write a cover letter (Sample attached)
2. Complete Form G-639 (Sample form �Freedom of Information Act - G-639 - Form.pdf� attached)
3. Write your I-140 Receipt # in �Column 4�.
4. Important: Make sure you complete �Column 7� or you will be asked to send you application again.

Usually, even if the employer or attorney put their address, the USCIS mails the card to the address marked as the home address of the applicant.
Note that the I-765(EAD) and AP are not mandatory forms. Talk your employer into saying "these are not required right now, we can file later". And once he files the 485 and 140, you can always file the EAD and AP yourself (or use a lawyer).
I have a feeling he's trying to keep all documentation to himself. Don't let your guard down.
Purely my opinion.

This is the sort of news we should publicize.
Here is a clear example of business leaders moving ahead of the politics of this issue. It will have an impact on any sensible person.
It should get onto as many news wires as possible. Which sensible person can say that those 1000 high paying jobs going to Vancouver/Canada is in the interest of Seattle/USA. Imagine to spin off losses of this, to housing, to retail, to all sorts of areas of the economy where many Americans make their livelihoods.
This is what people don't understand, push them too far and capitalists will weaken the US economy.

I was in EB2 with 485 pending. I applied in EB1 and had 140 approved. I asked USCIS to approve pending 485 based on EB1 140. My GC was approved but wife's petition, pending at another field office, was denied and the officer said there is nothing like linking pending 485!
Can we use the pearson memo to justify our case? The memo says both the petition dates should have current priority dates?!? Is that correct? Are there any other memos we can use to make our case? My wife cannot file another 485 as she does not have a non immigrant status.

your regular employment letter that you get from HR should work. There is no special format for POE.

USCIS updates the status with this generic message when they receive response to the RFE. Regarding the interview, I think its random and there is no specific criteria for USCIS.

I am a labour substitution case pd feb 2002 filed 140 in June at NSC. My 140 has been pending for more than a year. Now recently I received 2 year ead.
Does this imply my 140 is approved too???

Let the flowers reach them; let the suitors file the suit. But don't you think we should start a 'Seek information' campaign. Each of us write letters and faxes to DOS and USCIS and request them for this.
In May'07 the DOS moved forward the visa dates by 2 years for almost all categories. Now since USCIS have already receipted (or will soon do it) all the June applications, they should be in a position to release the information on how many applications they received for each category and for each country. We will request both the agencies to work together and release some kind of statistics some predictions like what they expect for Sept visa bulletin and further. We are living in dark and information like this will give us some insight and will let us plan our careers.
Guys please think about this seriously, I think this is the need of this hour.

I have a green card and I'm thinking about living 50/50 in US and my home country Slovakia.
I've had GC for about 6 years and been living quite a travelling life spending more time outside US then in. Its also about 50/50 with trips always around 10mo in or out.My continuous residency is broken.
Do you think that if i live 50/50 in and out for five years they will give me citizenship with such history?
Got GC after Mom.

If you spend more than 180 days a year in the U.S (total of 2.5 years in the 5 years preceding to the application) and show ties to the U.S (a house, tax returns, family etc). If so, it should not be a problem. The U.S ties come into picture only when you are out of the U.S for a extended period of time (like in your current case). Good luck.
